Attached you will find the version of SB11-013 (013_red.pdf) that passed the Colorado Senate last week. I have also attached a copy of the Colorado Dispute Resolution Act for your reference so that you can see how this Bill meshes with CDRA. The Bill will be moving on to the Colorado House soon, so I’d like to get your input on it as it now stands. I have also attached the “handwritten” version of the Bill that I was told would be the version on the floor for final passage last week. Amendments were made at the last minute on the floor, resulting in the version passed, (013_res.pdf) The definition section was changed to include “restorative justice practice” in civil cases and appears to eliminate any reference to restorative justice in criminal cases.
Also last week in the House Rep. Pete Lee’s Restorative Justice Bill, HB 11-1032 was passed unanimously by the House Judiciary Committee. This Bill addresses RJ in criminal cases. The latest version of the Bill that was passed by the committee, minus a couple of very minor wording changes, is also attached for your reference and comments.
I’m traveling today and early tomorrow but I look forward to hearing from you on these two pieces of legislation that may effect the practice of mediation in Colorado, after you have time to digest the latest versions of these Bills.
